Like every Bureaucrcy given some authority to make judgment call on matters that affect us, I am certain USPTO has an appeallate system in place that permits review of any decision by EXMINER which EDIG does not like...

I say EDIG, because there are no other parties to the case. They already have settled with EDIG and moved on...
