plankton....I reviewed the above considered...it's a list of non patent literature submitted by e.Digital for consideration in the re-exam process....At the bottom of the list are entry space for the examiner to sign...." sign"_______and "date considered"_________

It appears he has considered the literature. Why this is not filed to the wrapper makes no sense why it's utilizing the initial date of the statement and not the date signed would seem strange.

Anyway, the initial statement submitted comprises specific issues regarding e.Digitals legal case history.....both Texas and Colorado

IMO, nothing to get excited about. It appears to be an issue not filed properly at this point....it would be interesting to see when it was actually signed though. Perhaps he had to read through the case history before signing and excepting?
