Message: Why has this happened?

This all began in March 2008 when edig and DM filed the first nine lawsuits. Later DM/Edig filed another 17 lawsuits.

Many discussions have transpired over the last 4 years, not only on this board but several comments have come from management during this time period. The one that stands out is from Robert that implied the revenue from the total lawsuits could approximate 6 to 800 million dollars. I'm not sure if that was our split or the total with 40% going to DM. Our total to date is 16.046 million less the DM share, or approximately 2-2 1/2%, a long way to the end.

Had all gone well we should have been more than halfway through the patent settlement process. It didn't. Why? Many may not like my opinion concerning this matter, but I have difficulty looking at it any other way.

Many on this board don't understand, but DM lost the case in Colorado and put us in the position we are in. They failed, period. They must have made tactical errors along the line, but didn't get the results they wanted. It could have been the comment about the judge being overruled on a past case which made her angry. A thought, these judges are not stupid, they have been around many cases and know how to issue a final decision.

We are where we are and if we are lucky and get a favorable ruling on 737, and if the Flash R patent portfolio is still strong, then we may get back on track and try to generate the remainder of the amount that hs been discussed, although the amount now seems to large and who knows what the total may be.
