Guess what?

EDIG filed their response to the rejection and the USPTO has not taken any action yet.

What is there to appeal if nothing has been sent out?

At the Jan interview, an agreement in principal as to what would be acceptable wording to amend claim 5 was reached, just as done in Dec for all the claims re: 774, resulting in the NIRC.

My guess is, this is not an appeal in the true meaning of our interpretation of the "word" as it pertains to USPTO procedures.

This "appeal" filing Aug 30 does not add up? How do you appeal a decision if no decision has been made?

The paper flow we have seen does not have a rejection to EDIG's response..nothing there.

I'll leave it at that.
