With the few settlement conferences I participated in defending my employers position against the accuser, the 3rd party took no position. Basically had both sides present their case, then rendered a decision based on facts and only facts. No emotion, at all.
If Handal has accepted this process, then they must believe it is fair.
Seems to be an appropriate way to settle this without a Markman etc.
