I hear you Giants--while all of this may be good news, and I certainly hope that SNDK will fall in line which will cause others to follow, there was a bullet point in the definition of the ENE process that stated that it is "particularly appropriate when counsel or the parties are far apart on their views of the law and/or values of the case." From where we sit we cannot tell what SNDK has in mind or Edig for that matter. Maybe, since SNDK is the known resident expert on flash, it would behoove Edig to cut them a relatively sweet deal with an NDA with the hope that others would fall into line after that with more lucrative settlements. The water is getting hot--waiting for it to boil--fried or boiled, either way.
