None of the Defendants have appeared in this case to date. Since the last

motion was filed and particularly in the month of February 2013, the parties via

their counsel and/or apparent authorized agents, have been actively engaged in

discussions regarding the possible global resolution of this case. However, the

parties need additional time within which to discuss such matters.

Also, when the last motion for an extension of time was filed, Plaintiff was

still waiting for Defendant Mach Speed Technologies, LLC (“Mach Speed”) to

return the waiver of service of summons and/or, to have said Defendant personally

served with the Summons and Complaint. (See Docket #15). Mach Speed has

since that time executed and returned the waiver of service of Summons. (See

Docket #16).

Additionally, the Defendants via their counsel and/or apparent authorized

agents have indicated that they require more time to find local counsel to represent

them in this matter should the parties be unable to resolve this matter themselves.

Defendants via their counsel and/or apparent authorized agents have

specifically asked that Plaintiff make this motion with the Court given that they do

not have local counsel yet by which they can appear in this matter or even join in

this motion.
