In discussing during visits the 8-K and PR announcing the termination of the DM agreement and hiring of Handal, Fred pulled off a bold move and we have a winner in our camp. I recall lots of "trash talk" about Handal at iHUB in particular about this "no name 3 person boutique law firm."
Can you hear me now?
Fred knew DM simply ran out of steam. Two years +/- going thru the re-exams did them in and our cash position suffered a blow.
I recently re-read the Sept 17 8-K item 1.01 and realized we are not shelling out the $30K/mo, it will come from settlements.
"Handal has agreed to handle the Company's Patent Enforcement Matters on a partial contingent fee basis. The Company will pay a monthly retainer fee of $30,000 creditable against future contingency recoveries. Handal has agreed to advance related expenses excluding experts and prior art search firms."
We owe 7 months at this point, $210K plus other costs. Chances are the 1st settlement will take care of this nut. The months that follow we will pay them in the same way I guess...
Also BLR, we need to remember 18 companies settled without a trial and 1 licensed without litigation (#14) before the 774 & 737 were strengthened. These OEM's and retailers/distributors are very aware of this, or will be.
And as you said, "then, of course, there is NUNCHI."
To me, NUNCHI is the key ingredient for a continued revenue stream while we benefit from settlements as they dribble in. I hope I'm wrong, but don't think the market will react much if we get large values. I have always said, "it's not how much money we get from settlements/licensing, but what the company does with the money.
Buyback shares, make acquisitions, add staff to venture out into new areas?
IPmetrics was a very smart move by Fred!!!
