The reason for excepting settlements might also place weight as to how others have come to see that they were guilty of infringment since they were doing just what Apple and others were doing. Otherwise why wouild they settle if they thought Apple was right??? Doing it now was the cheapest way out. Going to trial and then loose would be a disaster for them. It appears they don't have much confidence on those issues that Apple has raised.
