I do not know if we are going to win the suit against Apple or, if we do, how much money it will be worth. What seems a virtual certainty to me is denial of collateral estoppel and postponing further decisions until a new Markman hearing can be held next March to include review of the patents after their reaffirmation and slight modification of 774. If this judge allows the collateral estoppel argument put forth by Apple, I will really question the fairness of the justice system as it relates to Goliath versus David.
