IMO, three things can happen ...

1. The judge denies the defendants motion...

The judges allows defendants motion in which, IMVHO, e.Digital has two choices.

2. Run with the Colorado claims construction for 774, and get the claims construction process started for 737.

3. Or shut down the cases(as they did in Colorado), allow the defendants to go free....and appeal the Colorado opinion....getting it out of the way.

It would be e.Digitals choice of what path to follow.

IMO, as for the company, they will not gamble on # 2 and will follow #3
