Just to add, yet again my consideration.....the court (Colorado) ruled incomplete on that which it ruled on.....It only ruled on the half of item B that benefited the defendants and nothing was considered of the digital issues in that claim term that e.Digital considered in its claims construction..

The claim term item B was not fully litigated......and as for item A..what is flash memory ?..DM advised e.Digital to hold off on having the court rule on that matter.

What flash memory is a straight forward issue....there is no secret surrounding what flash memory is. It's a block erasable entity....it does not have the ability of memory cell over write like RAM does....and you need the continuous ability of over write that RAM offers for the system to work.

flash can only be utilized for storage.

We were cheated in Colorado....and IMVHO...not just by the court short comings.
