I can understand that edig has been without an abundance of cash and the DM plan was to maximize their share of the settlements.

Even now edig is very low on cash, thus the last settlements were based on a one time payment amount, at least I believe that based on the quarterly report.

I am however suggesting it would be to our benefit to not only ask for a settlement amount based on the past infringement, but a royalty amount agreed upon on a per unit basis. This would be beneficial to both parties as there would not be an over/under payment and reflect future units sold and/or a percent of the income if usage is involved in the transaction. Other variables are also possible in determining the dollar numbers.
