It's good....it's a negotiation process....at this point the defendant has agreed to it....and it is now waiting court approval.

As I see things, it works this way....737...etc will go through the process of Markman proceedings by default.

The negotiation is, ...we (e.Digital) are giving you, defendant, a choice prior to the conclusion of Markman proceedings.

If we settle up on 737...etc... prior to the conclusion of Claims construction proceedings...through this stipulated agreement...we will waive any further prosecution of 774.

It is, however, contingent on settling 737... etc prior to any court ruling on Markman proceedings. If the court rules all bets are off and exhibits are then filed with any judgments.

It gives the defendants something to think about as the process unfolds.
