The judge is governing by process....he now has to govern the issue of 54(b) and how it relates in this case ...if it does....shortening the time line, etc.

I'm sure you would want your due process....if it can be presented procedurally. Stating, basically, you were hood winked is not procedure.

Does 54(b) fit, does changing the stipulated partial judgments as agreed fit, does the judge feel he was hood winked by e.Digital as the defendants are trying to convey to him, does the judge feel the defendants are crying foul in a proper manner, will the judge want to hear e.Digitals opposed considerations, fore which, he already knows what that will be.

The judge just wants to work under the guide lines of procedure, e.Digital needs to be on the right side of procedure.

Was the stipulated partial judgments a proper procedure?
