Collateral eStoppel Ramblings... In My Opinion Only. Right or Wrong, this is how I see it.
I completely and totally disagree with this quote:

In my opinion, from a technical point of view, Colorado JUDGE K's decision of Patent 774 was WRONG. The Judge's only sound reasoning was from a JUDICIAL point of view. The Judge's decision was meant to be a stake in the heart of Patent 774, nothing more, nothing less. From a technical point of view the decision is absurd but from a judicial point of view it's valid. So LEGALLY, it's all legit, but technically it's an invalid assessment of the working parts of the patent.
That's the elephant in the room that's not being talked about. It's a very sad thing and turning the decision around is going to be a difficult task for Handal, but not impossible. Up until now, it's the main reason all of the settlements are much lower than anticipated. You know it and I know it.
The TRUTH is out there but are you willing to admit it.
