Yes emit, I have read e.Digitals doc 34..

The CE appeal is about the judge ignoring the re-exam issues and the supporting issues of 108 which did not go through any re-exam.

The CE has nothing to do with Colorado Markman ruling...and everything to do with a re-exam by the USPTO.
