So based on sman's bolded portions I am assuming that the appeal request that Handal filed is an interlocutory application. The request was filed on Oct. 9th. The court has 45 days from filing to approve or not approve the application. If you court takes the whole time alloted, the decision to accept or reject our application will be known by about Nov. 22nd. Handal would then have 10 days to file the appeal and pay some fees to get the ball rolling. Again based on the average length for most appeals being 6 months, we could have the appeal verdict rendered approx. June 1st, 2014. The Markman hearing is scheduled for March 2014 and a final decision for that could be announced August or so next year. Don't hold me to any of the dates, just sort of typing out loud to arrive at a ballpark timeline.
