Huawei Asks Fed. Circ. To Revive Patent Dispute In Calif.

Law360, Washington (October 08, 2013, 4:48 PM ET) -- Cellphone maker Huawei Device USA Inc. on Tuesday asked the Federal Circuit to revive its California suit seeking invalidation of software patents asserted by Acacia Research Corp. in a related Texas case, arguing Huawei is a third-party beneficiary to an agreement that says disputes must take place in California.

Huawei Patent Suit Belongs In Texas, Fed. Circ. Says

Law360, New York (December 03, 2013, 7:55 PM ET) -- The Federal Circuit ruled Tuesday that Chinese cellphone maker Huawei Device USA Inc. would have to face the entirety of an Acacia Research Corp. patent dispute in Texas, shooting down the company's bid to deal with some of the claims in California.

The appeals court affirmed a trial judge's ruling dismissing Huawei's California declaratory judgment suit in favor of an infringement action filed the day before in Texas by Acacia. The cases, filed on April 3 and April 4, 2012, respectively, both center on the same...
