e.Digitals arguments will lean on the re-exam, as they tried to present and convey to the current judge...Which is now unambiguous in terms of RAM as a necessary entity to e.Digitals processes. A new Markman will be based on the appeal, if successful, if settlements are not concluded in the current cases.

Where ever it might happen, perhaps against the new defendants if things conclude in the appeal process in time and e.Digital modifies its case claims against the new defendants.

It' is, if you will, a comparative to what exists today as the patent is written, to what existed prior in CO.

That is what Handal must convey to the appeals court....this process will supersede the CO ruling setting a new president, that is all we should care about at this time.
