This may be a little technical, and Doni, you may have read more material than I, but I have a little different take on the Collateral Estopple.

First, I'll use my football analogy again. When the officials review a play, there must be clear visual evidence to overturn the officials on the field. In other words, there is a strong bias favoring the play as called on the field. I think the 9th Circuit will have a bias favoring the trial judge's finding of CE. The 2nd bias will be to NOT relitigate a finding of the Federal Court in Colorado.

My last technical point is that if our appeal is favorable to us, the case will probably be retuned to the trial court for litigation. We are a very long way from resolving our case against Huawei even if CE is denied on appeal.
