108 was not part of Apples litigation...and e.Digital did not modify its infringement actions...

I have no idea what e.Digital and Apple hatched that concluded the Apple case , but it sure was fast, and I think the judge, in reading his recent ruling on modifying the SPJ's was a bit stunned.

Apple did not even wait for the judges ruling and concluded leaving everyone else holding the bag.

Anyway, Handal will do whatever he needs to do for the remaining defendants that may, or may not be involved in CE appeal. It's up to them...or what they and e.Digital come to terms on.
