FWIW...

SNDK settled 774, they are just standing there watching the process with the 737 question in hand.

This process of the judge amending his SPJ's has kind of put SNDK at a disadvantage.

SNDK was waiting on the 737 March Markman hearing adopting issues similar to the 774 claims construction considered by CO defendants ....the no RAM issue was going to be a problem for 737 as well, that because of the CE ruling on 774.

Now SNDK must wait on the appeal as all issues are on hold pending appeal.

If they wait, the claims construction they then adopt for 737 will be dependent on the outcome of the appeal. If e.Digial gets a positive appeal SNDK has a problem, as that which they had previously adopted prior to the judges amendment of his SPJ order will be no good.
