I don't see how an appeal loss will invalidate any of the claims in the current flash patents, we know from the reeval of uspto the ability of the flash portfolio, ergo they can build microsignet on it's own merits utilizing 737/774/145 etc, now how it plays out with the current lawesuits may differ on their dept/scope of infriengment, and that may intertwine with them and effect future work with them if they wanted to utilize MS/Nci somehow but imvho ther's no reason it/they can't be build, ergo they are 'trying' to do so regardless of suits.
