"My guess is there won't be oral arguments"

Thing is, there’s two issues going on here:

1. 774... appeal decision to allow it to be re-litigated or not.... perhaps arguing the many different complicating reasons why it should be allowed…initial CO ruling…Re-cert USPTO to rectify language not understood by the CO judge…SC judges considerations for the CE ruling in disregarding the previous.

2. 108...it was not part of the CO ruling setting the fate of 774.... where 108 is a separate and distinct entity...perhaps this issue needs no oral argument.

Guess it depends on how the 3 judges have independently reviewed the case as to what is important. Is it decided based on majority considerations to hear the case orally? As in 1 against / 2 for.... 2 against / 1 for...unanimous one way or the other.

Anyway, the case has two issues involved.
