I agree , their is small chance of appeal of the 108 decision, it is not a precedence setting decision IMHO . The 774 (and SPJ) decision on the other hand not so clear - but I doubt e.digital will want to keep their focus and dollars appealing that one when they've so many other irons in the fire so to speak.
