For a few of the items construed by the court...the defendants venture this type of opposing statement....
"the Court must not have held in the tentative order that the term does not need further explanation. Instead, it must be that the Court is waiting to provide a full construction after the claim construction hearing."
The defendants feel the court was not through in its decisions of the issues...as construed.
More claims construction decisions after the Claims construction hearing?
Defendants are exhibiting a guessing game ...you know, like the e.Digital AGORA board.
The court used legal standards to come up with its considerations....and elaborated in detail those standards.
The defendants use must so often in statements....it used must one too many times.
