UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF CALIFORNIA E.DIGITAL CORPORATION, Plaintiff, CASE NO. 13-cv-2930-H-BLM ORDER GRANTING JOINT MOTION TO DISMISS WITH PREJUDICE [Doc. No. 39] vs. PNY Electronics, Inc. d/b/a PNY, Defendant. On December 6, 2013, Plaintiff e.Digital Corporation filed its complaint against Defendant. (Doc. No. 1.) On November 10, 2014, the parties filed a notice of settlement and joint motion to continue all deadlines until December 19, 2014 pending settlement. (Doc. No. 37.) On December 12, 2014, the parties filed a joint motion to dismiss with prejudice all of the claims in the case. (Doc. No. 39.) The Court, for good cause shown, grants the parties’ joint motion and dismisses the action with prejudice. Fed. R. Civ. P. 41(a). The Court further orders: 1. The parties will bear their own costs, expenses, and attorneys’ fees associated with the prosecution and defense of this action; and 2. The Court directs the clerk to close this case. - 1 -
The only remaining case in this subset of the consolidated cases is 13-cv-2943- H-BLM. The Court has stayed the deadlines in that case pending settlement. (2943 Doc. No. 31.) That case will be the low number case for this group until it is dismissed.
