1. Settlements have so far been the rule not the exception.
2. Many settlements have happened fairly quickly in just a few months.
3. We know of no settlements for significant dollars - only nuisance amounts so far.
4. Flash-R patents will soon begin to expire. I realize they can still go after past infringments to a certain point, but it is diminishing returns as time goes by.
It looks to me like Handal has been going for quick settlements - accepting relatively small amounts for relatively little work (filings but not much in the way of discovery or full trial preparation). They've so far been able to count on most companies just paying something to make the case go away. Even the most resistant company will pay to settle if the price is right... and so far the price has been right.
What would have to happen to change the above?
We'll go to trial when Handal refuses to settle; not so much the other way around.
So my thesis... maybe Handal would prefer their major efforts go into Nunchi, not Flash-R.
