Yes it still has to go through an approval process, I was a bit premature on a recent post stating the IPR will be approved for review..

It would be nice that the PTO review the MERITS and come to the conclusion that the e.Digital methods are NOVEL in comparison and are patented properly....there by, a formal review not be allowed.

If it could only be that simple.

What other MERITS could there be other than a comparison? Thing is the defendant is challenging 445 for the most part and not 108 directly, other than its claim 1 phrase. Perhaps, some where in that mix the IPR is denied.
