The Government has now seen fit to establish new guide lines as far as patents go....eg IPR's. IPR's do not happen unless a civil process is initiated. This is the bull s*** of the whole IPR process...catch 22?

How does one form a business plan of any kind based on the current state of affairs?

If the patents are not fully protected right out of the gate there is no sense of doing anything....As others can simply do as they wish and step right over the patents....eg NEST and a couple others.

emit, there is a common sense issue here as well.

They are fully challenged by a system that they must follow and get it right. If they do not establish first, they have nothing to protect whatever business plan they might attempt to heavily invest in.

From my prospective, they are hostage to the system...and they have to beat it first.
