It seems obvious to me that the PTAB asking for the CC order is so they can include that information as part of their decision making process on whether to grant or not grant the request for an IPR. Whichever way they rule, using it, in part, to make their determination strengthens their decision. No one knows how they will decide, but including information that is clearly in Edig's favor is a good thing. Not granting the IPR would be awesome. However, even if they let it go forward, the CC order will be useful during the review.
