The reason that these patents exist, is because of prior IP.

And that's not to say e.Digital is limited to just utilizing its prior IP.

e.Digitals prior IP is not a determinate factor as a background issue. NUNCHI patents are not composed to have to utilize e.Digitals prior IP.
