By that, I meant, might the defendants be forming a new conservative strategy?
Why fight, with very encompassing pending issues to be resolved?
The patents are:
Covered business method patents....of which e.Digital is trying to cover many business methods....... e.g ...subscriptions
Defendants don't even have to file for IPRs or stays ....just oblige e.Digital for now, sit tight like everyone else is doing....and take up a challenge, if need be, depending on the IPR resolutions.
RE: phrase from recent brief ....edig vs ShenZen......
"If the PTAB ultimately decides that all of the claims at issue in the IPR are invalid, then Defendants can seek relief from the requested injunction to the extent allowable under the law,"
IMO, injunctions are not exclusive in reading that phrase.
