"So, in Edig's original wording explaining what Nunchi can accomplish we could have used a better word than "social."
And using another word may have abandoned the social side....
It's not just about that word alone ,,,but a combination of words...
RE: social hierarchy
"e.Digital relies on The American Heritage Dictionary’s definition of a hierarchy as “[a]n arrangement of persons or things in a graded series,” ECF No. 50 at 14 (quoting The American Heritage Dictionary, ECF No. 50-10 at 398).
e.Digital explains that the specifications also illustrate that, under the claimed inventions, the hierarchy may also include “the quantity, and type of delivery, of information made available to different persons.” Id."
They needed to cover both sides of the equation so to speak....what verbiage would accomplish that ?
This is why "common specifications" throughout the patents is important...it ties the claims of both issues together through various patents.....including patents not involved in the IRR.
