It's not, its giving control to others by implicit legislation....the gov. is playing dumb on the issue...as it does with all issues.

IMO, small companies can win by doing, as I feel e.Digital is doing, proliferating patents with "common specifications".

We have a claims construction ruling on some of the "common specifications" in the civil court... e.g "Social hierarchy" that highlights both personal issues and non personal issues.....by way of the verbiage hierarchy itself.

We now have, subsequent that ruling, patent(s) that continue those exact "common specifications" however fortifying issues indifferent to personal considerations only.

With that, social hierarchy is now established as a common specification..... to consider both instances through multiple patents.

How long, with that consideration, will the common specification last..... if it's proven seaworthy through multiple patents?

For as long as they can come up with ideas to place behind it.

It's a matter of , can the petitioner beat a multiple patent issue?
