letgo, there is a stipulation involved in the Mivatek dismissal that spells out something.

The motion to dismiss heading for Mivatek by e.Digital with stipulation reads very similar to Googles, the only difference being the manner of dismissal.

If it was decided to just let Mivatek off the hook, as you kind of indicate above, e.Digial would not abandon their side of the dismissal with prejudice.

But there again:

We are getting a mixed message.... with the legal conclusions.

Mivatek order...

"The parties have filed a stipulation of dismissal dated June 30, 2016. ECF No. 33. Because the stipulation is signed by all parties who have appeared, it is effective without court order pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii). This case has been dismissed with prejudice. The Clerk shall close the file. IT IS SO ORDERED. Dated: June 30, 2016"

Should that order not indicate as to both parties with prejudice? It's as if this order is an informal issue between the parties and concludes with headings to their liking.
