The USPTO needs to be decisive in the initial patent prosecution. If the PTAB arm of the USPTO want to be the all reasoning institution with final say on all things patented.... they need to do their three panel judgment prior to a patent being approved.

What a mess the USPTO is.....it boils down to it being completely political. Where I see the e.Digital vs MSFT / Dartmouth College IPR proceedings as a political back fire.
