Thing is, after it's filed and perhaps passes muster, keep in mind that iBaby has 1 year to file an IPR...and can challenge a positive civil claims construction order.....just as Google did. Where we have no idea how the PTAB viewed that issue or it having any weight in the settlement / license agreement.

IMVHO, lots of political blocking...
