Private NPE e.Digital files three more enforcement actions against Netatmo, Y-Cam and Netgear

Private non-practicing entity e.Digital Corp. filed three enforcement actions against Netatmo LLC, Y-Cam Solutions LLC and Netgear Inc. in U.S. District Court in San Francisco alleging infringement of two patents related to systems and methods of managing mobile communication.

The patents in suit are U.S. Patent Nos. 9,002,331 and 9,178,983, both entitled “System and Method of Managing Mobile Communications.” The patents were issued in April and November of 2015. Patrick Nunally is the sole named inventor and e.Digital is the assignee and owner of the patents.

Nunally has been chairman and chief technology officer of Nethercomm Corp., in Escondido, California, since March 2005, according to his public profile on LinkedIn. He couldn’t be reached for comment.

E Digital is seeking damages for the defendant’s infringement of the patents-in suit and a finding that this case is exceptional and an award of reasonable attorneys fees.

E Digital and its counsel couldn’t be reached for comment.

The company has been an active enforcer of patents over the last few years, filing 12 enforcement actions against 13 defendants including Nest Labs Inc., Ibaby Labs Inc., iSmart Alarm Inc., MYFOX Inc., MivaTek International Inc., Shenzhen Gospell Smarthome Elect., New Sight Devices Corp.Ivideon LLC, Arcsoft Inc.and Dropcam Inc.

The company’s past enforcement campaign has focused on eight patents: U.S. Patent Nos. 9,178,983 B2 System And Method For Managing Mobile Communications; 9,002,331 B2, System And Method For Managing Mobile Communications; 8,311,524 B1, System And Method For Managing Mobile Communications; 8,306,514 B2, System And Method For Managing Mobile Communications; 8,311,522 B1, System And Method For Managing Mobile Communications; 8,315,619 B1, System And Method For Managing Mobile Communications; 8,311,523 B1, System And Method For Managing Mobile Communications; 8,315,618 B1, System And Method For Managing Mobile Communications.

The company’s enforcement action against Nest Labs, which was filed Jan. 22 was terminated July 27. The enforcement action filed against MYFOX on Dec. 17 was terminated March 8. The action against filed against MivaTek on Dec. 17 was terminated June 30. The action first filed against Dropcam in federal court in San Diego July 1, 2014 was later moved to federal court in San Francisco on Nov. 5, 2014 before being terminated June 27.
