`Pursuant to 35 U.S.C. § 317(b) and 37 CFR § 42.74(c), Petitioners and Patent Owner jointly request to keep the written settlement agreement filed as Confidential Exhibit 1025, which comprises confidential business information, separate from the patent file and confidential.

Petitioners and Patent Owner have complied with 37 CFR § 42.74(b) by submitting a true copy of the settlement agreement and a Joint Motion to Terminate concurrently with this Request. 

Petitioners and Patent Owner requested authorization to file the Joint Motion to Terminate and this Request, which request was granted by the Board.  

Confidential Exhibit 1025 should be made available only to Federal Government agencies on written request, or to any person on a showing of good cause pursuant to 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c).

`Accordingly, Petitioners and Patent Owner respectfully request that the Board grant this Request to treat the settlement agreement as business confidential information and to keep the settlement agreement separate from the patent file (for example, that the Agreement not be accessible through the public Patent Application Information Retrieval system, nor through the PTAB Patent Review Processing System).
