Both hearings, the Calif. and the Delaware were tape recorded.  The predominance of our questions were asked and discussed during the Calif. hearing which came first.  There was no discussion about the Delaware trustee recommendation during the Calif. portion as would be expected.  When the Delaware trustee began his portion, he stated that since the Calif. hearing was taped, the Delaware trustee will have access to it and it is not necessary to bring up the same questions.  The Delaware trustee seemed to be in a bit of a hurry and put people on the clock with their few new comments during the Delaware portion.  Our guys and, of course, the Delaware trustee himself, know what he has recommended so there was no need to discuss it.  It is my understanding that at the Oct. 5th hearing with the judge, the Delaware trustee will stick to his guns and recommend the dismissal.  At that hearing Falk will have legal representation.  It seems to me that it would be wise for us to have an attorney on our side as well if just for the hearing for a couple hours.  The judge could rule right then and there, or could put the decision off a few days.  At the end of the Calif. hearing the trustee said to our group that he recommended having legal representaion.  Pat and the board members that are ram rodding this are capable interested parties and I am confident will do what they feel is best at the time.
