Between the participants they are, but the same goes with AOL, Hotmail etc, for legal reasons. They have a "privacy policy" as a provider of ones email service, but don't think for a minute they cannot access your emails with just cause.
Also, law enforcement can access emails via a court order when doing an investigation.
