The federal court decision against HudBay is, in my opinion, a reflection of the growing anti-mining fraternity in Tucson. They don't want their views (to the south) of the Patagonia Mountains disturbed by this operation. It would probably be out sight anyway, but not for those who would venture into those mountains to look down upon the pit.
There are other high potential projects adjoining Rosemont. They will die or advance based on the outcome of this appeal. I suspect that Rosemont will win, though legal complications adding time to productive efforts do no one any good (except for the attorneys, of course).
In any event, this should have little bearing on mining activity in the Tombstone area.
