Agreed with most of the clause, but the word "change" is troubling. The OSC assigns responsibility to the company to determine if something is material or when something is changed from "not-yet-material" to "material". It looks like the regulation is loose here (or at least open to interpretation..., security lawyers would have a field day), since the company may say that it has received the results from the lab, but the results are under review by management, or being checked by another firm, or to be confirm by another lab (heaven forbids). So, because of all this precaution, the company is not in a position to determine if something is material, hence have nothing to release. Lovely!
- Rosehill: As it sits, it's true that the company has nothing which they would considered as material to report (due to some reasons as discussed above). But we don't really know if the results or news is bad.
Anyone else want to weigh in?
