I looked into this matter.

1) We will get a new board as both management and the opposition are for item 02, To approve the amendments to the company's articles to remove the staggered board provisions.
This is a good amendment since all directors will be up for election every year and thus, hopefully, more accountable to the shareholders. So we will see 5 fresh terms for directors at this AGM and regrettably for us, and perhaps a relief for him, Murry won't be a director.

2) The Court decided not to rule on the validity of the company's articles as it pertains to the timing of nominations at this point in time. This is important. The Court did not rule that Rainbird and Defreitas were ineligible as directors.

What this means is that the elections will stand. Rainbird and Defreitas will be noted by the Exchange as directors elect. If by a large majority the shareholders vote for these people then this will have to be recognized.

Now the company, namely Lori, will likely still try to block their appointment. She'll even go so far as to try to paint the Hastmans and Rutherglen as invalid. However with 3 directors, a majority, against her and a large vote in hand should this matter return before the Courts, the will of the owners (shareholders) would have to be recognized by the Court. This element was not in play at Tuesday's hearing.

This may be a two or more part battle. But with a large mandate from the owners (shareholders) of the company, we will eventually see a clean sweep of the current management of the company. Now is not the time to waiver. It's even more important to speak with a strong, united voice.
