Not an attorney but a barrister's response:

The British Columbia Supreme Court maintains an equitable jurisdiction to provide equitable remedies outside and beyond remedies available under common law or precedent. The court could provide relief to either agggrieved party to a contract, perhaps relying on the remedy of rectification (google that term for a layperson's description of the remedy)
