CUU has commenced discussions with Teck on the earn back options, that doesn't mean Teck is "on the clock" and Elmer has not confirmed the 120 days has started. The cautionary note states that Teck must decide if delivery of the positive FS constitutes delivery of a positive BFS as defined in the 2002 option agreement. In fact the 120 day clock cannot start until acceptance of the positive BFS and no timetable has been mentioned for Teck to make that decision. The description of the option agreement on the website appears to leave out some key information. I've tried to locate the 2002 option but the Sedar list stops at 2004. Maybe someone has a link.
