On March 11, 2016 Carmax published their 2015 Financial Statements. They covered the period ending October 21, 2015.
In the report this statement is made:
The Company has investigated title to its mineral properties and, to the best of its knowledge, the title to its properties are in good standing.
Well, they were in good standing then but if they really did investigate the title, as they said, then they would have known they were about to expire. These Financial Statements are audited as well.
While we all realize these things get signed because they honestly believe everything is fine...it might leave him legally bound to those words. How could he have checked them and then not noticed that weeks later they would expire?
On March 11, 2016 Jevin Werbes had to file a Certification of Re-Filed Annual Filings along with the Annual Financial Statements. In that official document that he signed he stated that he reviewed the document—including of course where he says he checked the claims.
