Turtle, I think there is more involved than just newspaper clippings. I am thinking those clippings are meant for the "change of control" aspect of the case.

There is more to the case as published in the 40F, as for what they are using to base this on I am not sure:

"The essence of the proposed derivative action is that the Board of Directors pursued the Las Cristinas project for longer than it ought to have pursued it and that the directors have allegedly mismanaged certain aspects of Crystallex’s operations in Venezuela."
